These Terms of Service ("Terms") are a binding agreement between you and PICTOREAL Inc. ("DUCPIC," "we," "us," or "our"), a company organised under the laws of the Republic of Korea, governing your use of the DUCPIC mobile application, website, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy (Australia), which is incorporated by reference. If you do not agree, do not use the Service.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) ("ACL") or any other law that cannot lawfully be excluded. Where these Terms would otherwise do so, they are read down to the extent necessary to give effect to those rights.
You must be at least 13 years old to use the Service. The Service is not directed to and may not be used by anyone under 13. If you are at least 13 but under 18, you represent that your parent or guardian has reviewed and agreed to these Terms and consents to your use of the Service, and that you use the Service under their supervision. By using the Service, you represent that the information you provide is accurate.
You are responsible for keeping your login credentials confidential and for activity under your account, except to the extent caused by us. Please notify us promptly of any unauthorised use. We may refuse, suspend or terminate accounts in accordance with Section 18.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own personal, non-commercial use. We reserve all rights not expressly granted. You may not copy, modify, distribute, sell, reverse-engineer, scrape, or create derivative works from the Service except as permitted by law.
4.1 Your content. The Service lets you create, post and share content, including posts, reviews, photos, comments, route plans and other materials ("User Content"). You retain ownership of your User Content.
4.2 Licence you grant to us. By submitting User Content, you grant DUCPIC a worldwide, non-exclusive, royalty-free, fully paid, transferable and sublicensable licence to host, store, reproduce, modify, adapt, publish, translate, distribute, communicate to the public and display your User Content in connection with operating, promoting and improving the Service, through any media now known or later developed. This licence continues after you stop using the Service to the extent your User Content has been shared with others or retained in routine backups. To the extent permitted by law, you consent to acts or omissions that would otherwise infringe your moral rights in your User Content.
4.3 Your representations. You represent that: (a) you own or have all necessary rights and consents to your User Content and to grant the licence above; and (b) your User Content does not and will not infringe any third party's intellectual property, personality, privacy or other rights, or any law.
4.4 No obligation to monitor. We do not endorse User Content and are not responsible for it. We may, but need not, monitor, review, remove or disable access to any User Content at any time where we reasonably consider it appropriate (for example, to address a suspected breach of these Terms or the law, or a risk to users or third parties).
