These Terms of Service ("Terms") are a binding agreement between you and PICTOREAL Inc. ("DUCPIC," "we," "us," or "our"), a company organized under the laws of the Republic of Korea, governing your use of the DUCPIC mobile application, website, and related services (collectively, the "Service").
PLEASE READ THESE TERMS CAREFULLY. SECTION 16 CONTAINS A BINDING ARBITRATION AGREEMENT AND A CLASS-ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A LAWSUIT IN COURT OR PARTICIPATE IN A CLASS ACTION. YOU MAY OPT OUT OF ARBITRATION AS DESCRIBED IN SECTION 16.5.
By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. The Service is not directed to and may not be used by anyone under 13. If you are at least 13 but under the age of majority in your state of residence, you represent and warrant that your parent or legal guardian has reviewed and agreed to these Terms and consents to your use of the Service; you may use the Service only under their supervision. By using the Service, you represent and warrant that you meet these requirements, that you are not barred from using the Service under any applicable law, and that all registration information you provide is accurate.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us promptly of any unauthorized use. We are not liable for any loss arising from unauthorized use of your account. We may refuse, suspend, or terminate accounts in our discretion as described in Section 18.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own personal, non-commercial use. We reserve all rights not expressly granted. You may not copy, modify, distribute, sell, reverse-engineer, scrape, or create derivative works from the Service except as permitted by law.
4.1 Your content. The Service lets you create, post, and share content, including posts, reviews, photos, comments, route plans, and other materials ("User Content"). You retain ownership of your User Content.
4.2 License you grant to us. By submitting User Content, you grant DUCPIC a worldwide, non-exclusive, royalty-free, fully paid, transferable, and sublicensable license to host, store, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and publicly display your User Content in connection with operating, promoting, and improving the Service, through any media now known or later developed. This license continues even after you stop using the Service to the extent your User Content has been shared with others or retained in routine backups, but you may request removal as described below.
4.3 Your representations. You represent and warrant that: (a) you own or have all necessary rights, licenses, consents, and permissions to your User Content and to grant the license above; and (b) your User Content does not and will not infringe or violate any third party's intellectual property, right of publicity, privacy, or other rights, or any law.
4.4 No obligation to monitor. We do not endorse User Content and are not responsible for it. We have the right, but not the obligation, to monitor, review, remove, or disable access to any User Content at any time, for any reason, without notice.
